These terms govern your use of Billie's website and digital platform. Any approved Billie Pay Advance is also governed by the Pay Advance Agreement and Pay Advance Repayment Schedule you accept.

1. About these terms

Billie Loans Pty Ltd (ACN 679 740 973) operates billie.loans and related digital services. References to "we", "us", "our" or "Billie" mean Billie Loans Pty Ltd. References to "you" or "your" mean a person who accesses or uses our website, platform or services.

These Terms & Conditions apply to your use of our website and platform. They should be read together with our Privacy Policy, any collection notice shown to you, our Target Market Determination, and the Pay Advance Agreement - Terms and Conditions and Pay Advance Repayment Schedule you accept for an approved Billie Pay Advance.

If there is an inconsistency between these Terms & Conditions and an accepted Pay Advance Agreement for a particular advance, the Pay Advance Agreement applies to that advance to the extent of the inconsistency.

2. Our service

Billie provides short-term Pay Advance services to eligible customers in Australia. Details of the product, including who it is designed for, are described in our Target Market Determination and in the information shown during the application process.

Submitting an application does not guarantee approval. We may decline an application, request more information, limit access, suspend access or stop providing a service where reasonably necessary for eligibility, affordability, fraud prevention, security, compliance, operational or legal reasons.

Product information, calculators, estimates and examples on our website are general information only. Your actual Pay Advance amount, Transaction Fee, total amount to repay, repayment instalments and due dates will be shown in the Pay Advance Repayment Schedule before you accept a Pay Advance.

3. Accounts and information you provide

You must provide information that is accurate, current and complete, and update us if your information changes. You are responsible for keeping your login credentials, device access and account secure.

You must not apply using someone else's identity, bank account, device, documents or information unless you are lawfully authorised to do so and we have accepted that authority.

4. Acceptable use

You must use our website and platform lawfully and responsibly. You must not:

  • use our services for fraud, unlawful activity, harassment, abuse or misleading conduct
  • provide false, incomplete, misleading or unauthorised information
  • interfere with, disrupt, scrape, reverse engineer or attempt to gain unauthorised access to our systems
  • upload or transmit malicious code, spam or material that infringes another person's rights
  • copy, reproduce or commercially exploit our content, brand or platform without permission

If we reasonably believe you have breached these terms, we may limit, suspend or terminate your access, take steps to protect customers and our systems, and exercise any legal rights available to us.

5. Pay Advance applications and repayments

If your application is approved, the Pay Advance will be governed by the Pay Advance Agreement - Terms and Conditions and the Pay Advance Repayment Schedule you accept. Those documents set out the approved amount, Transaction Fee, total amount to repay, repayment schedule, due dates, nominated account details, repayment instructions, offer validity and other terms specific to that Pay Advance.

You must ensure sufficient funds are available for repayments when due. If you are experiencing financial difficulty or expect you may miss a repayment, contact us as soon as possible so we can consider appropriate support. Information about hardship support is available on our Hardship Help page.

6. Payments and service providers

We may use banks, payment service providers, bank statement providers, identity verification providers, communications providers, cloud hosting providers and other service providers to operate our website, platform and Pay Advance services. These providers may have their own terms or consent flows where you interact with them directly.

7. Privacy

How we collect, use, disclose and protect personal information is set out in our Privacy Policy and any collection notice shown to you. By using our website or services, you acknowledge that information is handled as described in those documents.

8. Intellectual property

All content published or made available on our website or platform, including text, images, logos, trade marks, documents, software, design elements and downloadable files, is owned by Billie or used by Billie under licence. You may view and use that content for personal, non-commercial use connected with our services. You must not copy, reproduce, modify, distribute or commercially exploit it without our written permission.

9. Third-party links and services

Our website or platform may include links to third-party websites or services. We are not responsible for the content, availability, security or privacy practices of third-party websites or services, except to the extent required by law.

10. Consumer protections

Nothing in these Terms & Conditions excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, the ASIC Act, the Privacy Act or any other law that cannot lawfully be excluded, restricted or modified. If a guarantee, warranty or condition is implied by law and cannot be excluded, our liability is limited only to the extent permitted by law.

11. Limitation of liability

To the extent permitted by law, we are not liable for loss caused by your breach of these terms, your unlawful conduct, your failure to keep your account secure, or events outside our reasonable control. We do not limit liability for fraud, wilful misconduct, gross negligence, or any liability that cannot lawfully be excluded or limited.

12. Changes to these terms

We may update these Terms & Conditions from time to time to reflect changes to our website, platform, services, legal obligations or operational requirements. The latest version will be available on this page. If a change materially affects an existing accepted Pay Advance Agreement, that Pay Advance Agreement will continue to apply unless the change is permitted by that agreement or by law.

13. Complaints and questions

If you have a concern or complaint, please contact us. We will acknowledge your complaint within one business day, or as soon as practicable, and aim to resolve it within 30 calendar days. See our Complaints page for more detail.
